This session will discuss two legal regimes that impact electric cooperatives that are awarded federal funding for construction projects, such as those awards and tax credits pursuant to the Infrastructure Investment and Jobs Act and the Inflation Reduction Act. Davis-Bacon is a requirement that labor on most federally funded construction projects are paid the “prevailing wage.” Build America, Buy America requires that all iron, steel, manufactured products, and construction materials used in federally funded projects for infrastructure must be produced in the United States.

Learn how electric cooperatives can navigate these requirements for a successful federally underwritten project.


Learning objectives:
  • Identify when Davis-Bacon applies and what it means when it does.
  • Understand the domestic preference requirements and the impact the Build America Buy America Act is having on how electric cooperatives procure material and components for projects underwritten by federal awards.
  • Gather information and tactics to navigate the requirements for a federally underwritten project.
