​​​The National Rural Electric Cooperative Association (“NRECA”) submits this Answer1 in support of the Petition for Declaratory Order (“Petition”) filed in this docket by Southern Maryland Electric Cooperative, Inc. and Choptank Electric Cooperative, Inc. (collectively, “the Cooperatives”). 2 The Petition requests that FERC review certain aspects of regulations promulgated by the Public Service Commission of Maryland (“MD PSC”) regarding community solar energy generation systems (“CSEGS”) and issue a declaratory order finding that said aspects of the MD PSC’s CSEGS regulations3 fail to comply with federal law, including the Public Utility Regulatory Policies Act (“PURPA”) and the Federal Power Act (“FPA”).
