NRECA—together with American Municipal Power, Inc., the American Public Power Association, the Edison Electric Institute, and the Public Power Association of New Jersey—requested rehearing of the U.S. Federal Energy Regulatory Commission's (FERC) Dec. 1, 2017, declaratory order in the Advanced Energy Economy proceeding, FERC Docket No. EL17-75. The Joint Parties do not challenge FERC's decision in the order to permit the Public Service Commission of Kentucky to bar or restrict retail customers of utilities under its jurisdiction from participating as suppliers in PJM's capacity market. The Joint Parties only seek rehearing and clarification of the other portions of the order, which provide an erroneous, unworkable framework for deciding these issues in other states.
