NRECA has filed a petition for review with the D.C. Circuit challenging the Federal Energy Regulatory Commission’s recent order governing the manner in which storage resources should participate in centralized wholesale electric markets. Although NRECA supports the integration of storage into wholesale electric markets, NRECA believes FERC has overstepped its jurisdictional bounds by limiting the ability of states and local regulators to manage the integration of storage on local distribution facilities and behind the retail meter. NRECA has a pending request for rehearing with the Commission, but has made a protective filing now with the DC Circuit to ensure that our request for review is timely in light of another case pending at the court that could affect the time at which such petitions need to be filed.
