On February 5, 2020, NRECA and the Minnesota statewide filed a petition for leave to participate as amici curiae in a Minnesota Supreme Court case. The petition supports review of an intermediate appellate court's decision requiring an environmental review by Minnesota of a power plant being built in Wisconsin by an affiliate of Minnesota Power, which will also provide power to Dairyland Power Cooperative. Dairyland and other Wisconsin utilities are filing a separate petition supporting review. The Minnesota Supreme Court is likely to decide in the early spring whether to review the case, at which time parties and amici would file substantive briefs.
