​NRECA joined an amicus brief filed with the 9th Circuit Court of Appeals in Friends of the River v. National Marines Fisheries Service, et al. and Yuba County Water Agency. This case deals with whether an agency's Endangered Species Act (ESA) review must analyze the effects of pre-existing structures, such as dams, on listed species and critical habitat as part of an agency action when conducting ESA Section 7 consultation. The case could potentially have a large impact on co-ops given that about 600 distribution co-ops receive hydropower directly, or indirectly through G&Ts. FULL AMICUS BRIEF
