​NRECA filed comments with the U.S. Fish and Wildlife Service (FWS) on its proposed listing under the Endangered Species Act of the eastern black rail as threatened and an accompanying 4(d) rule for implementation. NRECA supports the 4(d) rule but requests some clarifications to ensure that distribution rights-of-way, associated electric infrastructure, and infrastructure built out by co-ops in the future will be covered.
