​NRECA, along with the American Petroleum Institute, the National Association of Home Builders, and the Utility Water Act Group, filed comments with the Department of the Interior and the National Oceanic and Atmospheric Administration on recommendations for establishing the regulatory definition of habitat through rulemaking to implement critical habitat provisions under the Endangered Species Act (ESA). We recommend that a regulatory definition of "habitat" should specify that only those areas that are actually habitable at the time of critical habitat designation are "habitat." FULL FILING
